By using the CybOff Application, you agree to the Terms of Use Agreement (TOS) below. This Agreement takes effect when you click the “SIGN IN” button on the CybOff Application or, if earlier, when you use any of the services provided by Affordable Cyber Solutions, Inc.
You represent to Affordable Cyber Solutions, Inc. that:
- you are lawfully able to enter into contracts (e.g., you are NOT a minor) and
- you are not legally barred from receiving Affordable Cyber Solutions, Inc’s services under U.S. Law.
Affordable Cyber Solutions, Inc. reserves the right to modify this Agreement without prior notice.
1. Affordable Cyber Solutions, Inc
1.1 Generally
You may access and use the CybOff application by the terms of this Agreement. You will adhere to all laws, rules, and regulations applicable to your use of any of Affordable Cyber Solutions Inc’ services.
1.2: Third-Party Software Utilized by Affordable Cyber Solutions, Inc
You acknowledge that Affordable Cyber Solutions, Inc. utilizes third-party software to enable some services provided to you. You agree to act by all terms set forth by the third-party software we use. You further acknowledge that if Affordable Cyber Solutions, Inc.’s ability to utilize its third-party software becomes impaired, CybOff application may not be able to provide its services to you. If this happens, Affordable Cyber Solutions, Inc. is not legally liable for any data loss or inconvenience you may experience.
1.3: Transferability of Rights
The rights granted to you by this Agreement are non-transferable. You assume liability for all acts performed utilizing CybOff application. If you suspect that your CybOff application account has been compromised, you agree to notify Affordable Cyber Solutions, Inc. immediately.
1.4: Where Your Rights Exist
You agree to exercise your rights under this Agreement only on a mobile device you own or control.
1.5: Diagnostic Purposes
You consent that Affordable Cyber Solutions, Inc’s will use data relating to how you utilize our services for diagnostic purposes and to improve the application performance. This data may include, but is not limited to, your location and different options you may select when interacting with CybOff App.
1.6 Law Enforcement
Affordable Cyber Solutions, Inc. will comply with all legally valid court-ordered warrants and subpoena requests.
2. Fees and Payment
This application is free to use.
3. Unlawful Activity
You agree to abstain from all unlawful activity arising from the use CybOff application. This includes, but is not limited to, intellectual property infringement, image misappropriation, hacking, fraud, phishing, or any other illegal or unlawful activity.
Affordable Cyber Solutions, Inc reserves the right to revoke your access to any and all Affordable Cyber Solutions, Inc services if it is suspected or discovered that any illegal or unlawful activities were perpetrated while utilizing CybOff application or if it is suspected or discovered that any illegal or unlawful content is or has been created or stored under your account
4. Security
Affordable Cyber Solutions Inc. agrees to:
- Reasonably maintain the hardware that supports the services provided.
- Take reasonable precautions against system outages and data loss.
- take reasonable steps to protect service from security breaches.
You acknowledge and agree that despite Affordable Cyber Solutions, Inc.'s reasonable efforts, it is impossible to guard against all circumstances that may affect your access and usage or which may result in data loss.
You agree to abstain from engaging in any activities while utilizing the CybOff application that could compromise the security of the Affordable Cyber Solutions, Inc. system architecture. You agree that if it is discovered that you are engaging in any activity that could reasonably be construed as a security risk, your account privileges may be terminated without notice.
Affordable Cyber Solutions, Inc. anticipates the periodic need to upgrade the CybOff application. Affordable Cyber Solutions Inc agrees to take reasonable steps to ensure the security of your content as well as uninterrupted access to the CybOff application during these upgrades. You agree that Affordable Cyber Solutions Inc. has no legal liability of any kind, including loss of access or data you may experience as the result of an upgrade.
5. General Warranties
5.1 Generally
You agree and acknowledge the inherent risks that are associated with remote computing. You agree that you completely assume all of these risks and that Affordable Cyber Solutions, Inc is not legally liable to you for any reason, including but not limited to, data loss, content loss, revenue loss, business opportunity loss, profit loss, or any other loss you may experience in connection with the use of the CybOff application and any other Affordable Cyber Solutions, Inc services.
You will indemnify and hold harmless Affordable Cyber Solutions, Inc., its Employees, Directors, Advisors, Affiliates, and Agents from and against any claims, damage, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of our services.
Affordable Cyber Solutions, Inc. is not liable for any delay or failure to perform under this Agreement that results from a cause beyond our reasonable control.
5.2 Disclaimers
Affordable Cyber Solutions, Inc services are provided “as is.”
Affordable Cyber Solutions, Inc, our Employees, Directors, Advisors, Affiliates, and Agents make no representations or warranties of any kind, whether express, implied, statutory or otherwise regarding our services including any warranty that our services will be uninterrupted, error free or free of harmful components, or that any content, including your content or any Third Party Content, will be secure or not otherwise lost or damaged. Except to the extent prohibited by law, Affordable Cyber Solutions, Inc, our Affiliates, and Licensors disclaim all warranties, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, or quiet enjoyment, and any warranties arising out of any course of dealing or usage of trade.
5.3 Limitations of Liability
Affordable Cyber Solutions, Inc, our Employees, Directors, Advisors, Affiliates, and Agents will not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages (including damages for loss of profits, goodwill, use or data), even if a party has been advised of the possibility of such damages. Further, neither Affordable Cyber Solutions, Inc nor any of our Employees, Directors, Advisors, Affiliates, and Agents will be responsible for any compensation, reimbursement, or damages arising in connection with: your inability to use our services; the cost of procurement of substitute goods or services; any investments, expenditures, or commitments by you in connection with this Agreement or your use of or access to our services; or any unauthorized access to, alteration of, or the deletion, destruction, damages, loss or failure to store any of your content or other data.
5.4 Affordable Cyber Solutions, Inc. Intellectual Property
You acknowledge that the CybOff Application is the intellectual property of Affordable Cyber Solutions, Inc. You likewise acknowledge that our business structure and server setup include trade secrets and other proprietary technology belonging to Affordable Cyber Solutions, Inc.
You agree not to take any action or attempt to reverse engineering our technology. You agree not to infringe our intellectual property. Such infringement may include, but is not limited to, using Affordable Cyber Solutions, Inc.’s trademarks, reverse engineering, or infringing one or more of Affordable Cyber Solutions, Inc.’s patents, among other actions.
5.5 Choice of Law Provisions
Should a dispute arise under this Agreement, you agree that this Agreement shall be governed by and construed per the laws of the State of Florida, without regard to its conflict of laws rules.
5.6 Full Agreement
If you disagree with this document in full or in part, please log out and immediately delete the CybOff application from your phone.
6 Referral Module
You must agree to abide by the terms and conditions contained in this Agreement to use the Referral Module. By creating a Referral, you indicate your acceptance of this agreement.
The following items shall also apply to your participation in the Referral Module.
- Referral payments can be taxable. Before receiving any Referral, payment USERS may be requested to execute a 1099. Some exceptions apply.
- Duplicated Referrals will be handled as follows: The first person submitting the Referral, based on the timestamps in our database, will receive credit for the Referral.
- Qualified Referrals are considered valid for 1 year.
- Affordable Cyber Solutions reserves the right to limit or restrict the option to create referrals to any user at any time and for any reason.
Referral Rewards are paid within 7 days of Affordable Cyber Solutions receiving payment from the Service Agent or the Registered Company that created the Referral.
- In the event of any conflicts arising, Affordable Cyber Solutions will disclose to the User all relevant information related to the transactions and mediation between the parties.
- By using the Referral Module, you agree to indemnify Affordable Cyber Solutions, its officers, directors, agents, advisers, and employees against any claims that may arise from the actions or inactions of any party involved in misrepresentation.
- The Referral Module is subject to all national, state, and local laws.
7 Business Cyber Offers
You must agree to abide by the terms and conditions contained in this Agreement to use the review offers posted by businesses around you that are displayed at the bottom of some pages.
Business owners have the option to cancel any offer they post at any time without providing notice. By reviewing the business offers, you agree to indemnify Affordable Cyber Solutions, its officers, directors, agents, advisers, and employees with respect to any claims that may arise from any damages that may occur directly or indirectly as a result of the use of these offers.
